2003 Subaru automatic transmission problem, over-drive gear (?)?

I bought a 2003 Subaru Legacy L in december with 63,500 miles on it. When I test drove it, I didn't notice any problems. However, I think there might be a problem.

When I am driving, and let off the gas (such as to go around a corner), and then give it some gas, the car jerks if I am doing 35 MPH at the time I give it some gas. I don't slam on the gas. I know this has SOMETHING to do with the overdrive gear, as it will not do this when I have it in 3rd. It only does it when I have it in 'D', and wont do it when I'm doing anything below or above the 34-36 mph range. The problem is that I live on a narrow, windy country road, and I'm always doing 35 mph.

Also, if I am simply accelerating past 35, up to a higher speed without letting off the gas, the car shifts just fine when it hits 35. Nor will it jockey between gears when I am coasting at 35

Is this a transmission problem, or is the tranny just annoying like this?

Update: I forgot to add that I got the extended warranty when I bought the car. The information says that "all internal parts" are covered.

Several people have mentioned the bands could be slipping. Dumb question, but would be bands be an internal part?

    the tranys on this subaru have allways been problematic,but there are other things it could be check your c.v shafts if could be that one of those are going out.or your u joints on the back could be going.its as simple as getting uder there and looking if theres nothing worng with those two then its your tranny.

    Sounds like my old WRX. I always kept it in 3 unless I was on the freeway. Prevented unnecessary shifting when driving through the city.

    sounds like the tranny needs a tune up ( new oil, new filter, tightening the bands, etc.) sounds like the bands are slipping
