Getting sued by a burglar?
Can I get sued by someone who breaks into my home and gets injured in the process? I have a German Shepherd currently in personal protection training. I'm wondering if I could be liable for injuries a burgler would sustain from a dog bite.
@heidi; a professionally trained personal protection dog does not viciously attack people unprovoked. They bite on command only. They are not out of control when given the bite command, their aggression is being channeled through proper obedience and training. My dog is a happy go lucky typical dog until there is a real threat. Real protection dogs have even stable temperaments that are intelligent enough to recognize what a situation calls for.
@Randy; if a trained dog bites when not provoked, then it shouldn't have been trained. What is your definition of unprovoked. If getting in a dogs face when he doesn't know you and getting nipped is your idea of unprovoked, then you're wrong. He is simply saying I don't know you and I don't want you in my face. You don't know the first thing about animal behavior. If a dog jumps the fence and bites someone walking on the sidewalk across the street, that is a red light dog that bit unprovoked. That type of dog shouldn't ever be considered for personal protection.
By the way, I did look up whether a person could be sued by a burglar and all I found were sites that said that I wouldn't be.

Unfortunately, the way the legal system is in our country (USA), you can be sued for anything, even something you never did!!. Someone you never met could sue you for pushing him over and breaking his leg, even if you never did that, and he doesn't have a broken leg or any other injury. PEople can file a lawsuit that's completely full of lies. Usually they won't, because they don't stand much chance of winning anything, but the fact is they CAN do it.
I would suggest that if you live in an area that tends to be more oriented towards protecting the rights of criminals, than the rights of victims, that you put a sign on your front and back door, warning would-be burglars that you have a dangerous attack dog on the premises. This warning could protect you in the off chance of a lawsuit by a bitten burglar. It could also help prevent a burglary to place a very large dog dish and a sign above it saying "BRUTE" in a conspicuous location, where a burglar would come across it on the way in. Such a sight could be a nice deterrent.

Even professionally trained police dogs, who are trained to react on command, can and DO bite for no reason or unprovoked. If you are under the mistake belief that they only work on command then you will deserve to be sued.
And yes, burglars can and sometimes do successfully sue the people they were trying to rob. Just do a simple search for "thief sues homeowner" or "burglar sues victim"

Sure you could. You COULD also get sued because the burglar doesn't like the shoes he stole from you. It doesn't mean he'd win.
Typically, owners are not held liable for animals doing exactly what they are supposed to do (e.g. defending the home.) If you trained the dog to be particularly vicious and attack people unproked, that might be different.
ETA @ your reply: Yep, I get that. I wasn't assuming; that's why I said "if." Just clearing that up.

We've all heard the one about the woman who spilled scalding coffee and successfully sued McDonald's. But we've also heard reports of burglars suing homeowners after injuring themselves during a robbery.

Yes, and most cases he will be laughed at. MOST cases. If it was somewhere like California, there is a chance you will lose. My honest opinion, if you were to be sued in California, I suggest counter suing over the burglar hurting your dog.
