If Family Matters, Why Aren't We Pressing For Candidates "Presumptive Joint Custody" after a Break Up?
Surely the Presidential candidates have an opinion on who gets children after a divorce or non-marriage break up? The candidates spend alot of energy discussing Family Values, but not once, except regarding Gay Marriage/adoption, does the subject of what should happen to children after a relationship ends?
I personally think that since both people made the child, the law should mandate both parents have equal access to them, unless they can show just cause they shouldn't (child abuse, mental problems, co-dependency etc.).
Before you say it isn't a federal matter, remember the Federal Laws such as the Family Marriage Act and the Uniformed Joint Child Custody Act?
Your thoughts?
Wambajes, there is already a federal law call the Uniformed Jurisdiction Joint Enforcement Act or something to that nature. Not to mention countless State Department regulations. All of these are set to limit father's rights and give preference to women.
Shared Joint, in my opinion can't tie judges hands. It presumes both parents share custody since they both made the child, unless either party can show that the other person is unfit due to drugs, abuse or whatever.
This kind of legislation is needed to protect good men, not assume all men are irresponsible until proven good.

I don't want a blanket federal rule covering this. I think it would be a bad idea to tie judges' hands like that. As messy and complicated as it is, I think it's important to give judges the latitude to decide every case individually.
