VIC check after insurance right off?

Does anyone know how you go about this? The insurance company has said the car can be bought back but needs an MOT and a VIC check. Can anyone tell me which order these have to be done in, will the car be classed as unroadworthy until new mot is issued even though it is still covered by the old mot?

    To start with your old MOT is still valid and under law you are not required to have a new one until it expires. A "write-off" does not invalidate a current MOT certificate (for that matter nothing actually can invalidate an MOT despite many common misconceptions). Many, many insurance companies imply that after a write off you must legally have a new one carried out. This is not true! If the insurance company tell you you need one then this is purely their own, in-house policy. Really it's up to you if you want to have a new one done but all it will mean is that you will have two MOT's, the second existing only to satisfy the insurance provider and not a legal necessity.

    As for the VIC then this is a legal requirement. However a VIC marker against a vehicles registration record in itself does not mean the car cannot be driven. So long as you have valid insurance, MOT and tax you can still drive the car even if a VIC is needed (remember, simply because it is a write-off does not mean you cannot obtain new insurance cover and your current MOT and tax will still be valid). You must first check if a VIC is required (as you cannot volunteer to have the inspection). You can do this either by calling VOSA on 0300 123 9000 or through this link:

    If it does need a VIC then you must complete a VIC1 application form. You can do this from this link:

    It cost's £41 and if you want to submit the form electronically then you have to pay with a debit or credit card (be aware that if the form is submitted electronically then the applicants name on the form must be the same as the card holder - VOSA policy). If you want to pay with a cheque, etc, then it'll be best to print it off and post it.
