1. How are the powers of the three branches of government distributed so as to create a system of checks and balances. List at least one power that each branch has over another.

1. The judicial branch has the power to strike down or make illegal any actions carried out by the other two. The executive must approve bills created and passed the legislative. The legislative approves who the executive nominates for the judicial branch, and reserves the right to regulate the amount of Supreme Court justices there are. The executive can deploy troops but only the legislative can declare war. The Senate approves all treaties, judicial appointees, diplomats, and heads of the different offices like the people of the FCC or the Federal Reserve.
2. The Supreme Court (SC) has done what is called incorporation. The Bill of Rights (BOR) was previously only applied to federal crimes, not state crimes. Through a series of cases, the rights guaranteed by the BOR have been incorporated, or also applied to any type of crime. An example is the right to counsel. This was incorporated by the SC case Gideon v. Wainwright. Through the incorporation theory, Americans gained their rights guaranteed in the BOR by the power of the SC. The SC also has the power to outlaw and strike down laws that infringe on an individual's rights, such as the freedom of speech. An example is the case Brandenburg v. Ohio, which dealt with free speech and the KKK. Any acts like search and seizures or acts of Congress that limit personal rights can and usually are struck down by the Court.
3. The president has the power to sign bills into law. That is why he is the chief legislator. Only he has the power to makes bills law. The president is also commander in chief. He can deploy the army at any point, which has been exercised by President Bush and our presence in Iraq and Afghanistan. He does not need congressional approval, unless he seeks to declare war. These two are very different roles; one is for the offensive around the world and the other is creating rule of law domestically.

1- The government is divided in to the legislative, executive and judicial branches. The Judicial branch has the power to have sex with midgits. The executive is allowed to smoke crack whenever, and the legislative is allowed to eat trans fat.
